Vito De Lucia has contributed to a blog on "Squaring the Oceanic Circle? On Regional Approaches to the Conservation of Marine Biodiversity in Areas beyond National Jurisdiction"The question of a global or regional approach to the institutional architecture of the treaty remains one of the key knots of the negotiations towards a new treaty on marine biodiversity in areas beyond national jurisdiction (BBNJ). The post shares some reflections on a recent proposal from Iceland on a potential framework for a regional implementation of the BBNJ treaty.
"The Application of Teachings by the International Tribunal for the Law of the Sea" Sondre Torp Helmersen has contributed to a post on the NCLOS blog, describing how the International Tribunal for the Law of the Sea (ITLOS) applies the ‘teachings of the most highly qualified publicists’ (as the ICJ Statute Article 38 puts it) when deciding cases. The post builds on an article published in the Journal of International Dispute Settlement. The article undertakes an empirical analysis of the ITLOS’ judicial methodology, and is the first such analysis of the Tribunal. Findings include Judge Laing being the heaviest user of teachings in the Tribunal, and the Virginia Commentary being the most popular book.
