Theoretical subject.
Master's level.
The course consists of several components. The first aims at providing a general overview of the different maritime coastal zones (internal waters, territorial seas, contiguous zones, exclusive economical zones and continental shelves.) The principles and procedures for the delimitation of overlapping claims of maritime zones will constitute the second element together with the principles and procedures for establishing the outer limits of the continental shelf. In the third element the focus will be on the rules, principles and procedures applicable to the individual coastal zones. The focus will be on the balance struck between the traditional freedom of navigation and the coastal states´ needs to prescribe and enforce in order to control such navigation. Especially important in the course is to study the existing rules regulating navigation representing a danger or threats to the marine environment. The course will illustrate how the legal regime differs between the various zones. The right of exploitation of living and non-living resources in the different zones will also be examined.
The fourth element will focus on the global common areas such as the high seas and the Area under part XI of LOSC. A unique element of the LOSC is the dispute settlement mechanisms, which will constitute the fifth part of the course.
