JUR-3619 Energy Law - 15 ECTS

Type of course

Master level students.

Admission requirements

Students should have a basic knowledge of administrative law and international law. Students who do not have admission to the Master of Law-studies at the Faculty of Law must contact the Faculty for information about required qualifications and how to apply for this course.

Course content

The course will cover the following topics: introduction to energy and energy law; energy policy - including links to energy security and environmental policy; ownership of energy resources; oil and gas licensing regimes; the protection of energy investments; the regulation of the energy industry both network bound industries (electricity and natural gas) and regulating for competition; legal issues associated with the renewables sector (e.g. wind and solar) and energy conservation including market based schemes (e.g. green and white certificates)

Objectives of the course

Knowledge:

Having passed the exam, the student has

  • acquired advanced knowledge (AK) of energy ownership, licensing regimes, the regulation of network bound industries and regulating for competition and
  • knowledge (K) in relation to other aspects of the course.

Skills:

Having passed the exam, the student is able to

  • identify and analyze legal problems of both theoretical and practical character in the energy sector.
  • apply knowledge gained of energy law and regulatory concepts in a critical and independent way.
  • identify and discuss limitations of the current law.
  • construct and communicate legal reasoning, orally and in writing, in a clear and precise manner.
  • have some appreciation for comparative method as a means for examining the legal regulation of a particular industrial sector.

 

General competence

After passing the specialization, the student can:

  • Apply the knowledge and skills obtained in the field of Energy Law individually and in cooperation with others
  • Communicate reasoning within the field of Energy Law in a clear and precise manner, orally and in writing to the academic community and the general public
  • Apply knowledge and skills acquired within Energy Law in all jurisdictions and for all tasks and projects where relevant
  • Identify and reflect on ethical dilemmas that may arise within the Energy Law area in particular and deal with these in a responsible manner


Language of instruction and examination

All teaching will be held in English and the exam must be written in English.

Teaching methods

30 hours of teaching divided between lectures and seminars. Student participation is sought through discussion of the prescribed material.

Assessment

The course is assessed through a 6 hour written exam. The exam may include theoretical and/or scenario questions. Students may bring a dictionary into the examination room. The grading scale of A to F is applied, where F constitutes fail. Students who fail their examination are entitled to re-sit the examination, cf. Regulations for examinations at the University of Tromsø Sec. 22.
