The constitution is largely written in gender neutral term. The Constitution has restructured the Nation into a federal republic. The Constitution has divided the nation into seven states and finalized the march of the Nation towards republicanism from constitutional monarchy and federalism from unitary system. Bicameral parliamentary system has been created with two houses at the Center and unicameral parliamentary system in each state. Mixed electoral system has been opted for the elections of the lower house at the Center with both first past the post election system and proportional election system are used to elect members of the lower house. Rights of gender and sexual minorities are protected by the new constitution with provisions of special laws to protect, empower and develop minority groups as well as allowing them to get citizenship in their chosen gender. Recognizing the rights of women, the constitution of Nepal explicitly states that “women shall have equal ancestral right without any gender-based discrimination.”Bans any acts leading to conversions from one religion to another. It also prohibits acts that undermine or jeopardize the religion of another. At the same time it declares the nation to be secular and neutral toward all religions. Nepal also has continued to abolish the death penalty. Nepal had abolished death penalty in 1990 after the promulgation of the Constitution of the Kingdom of Nepal. The Constitution defines wide range human rights as fundamental rights to all ethnic/indigenous tribal casts


Linguistic, Literature and Culture of ethnic/indigenous community in Nepal

Nepal is a multilingual, multi-literature, Multicultural country. Ethnic/Indigenous communities are the pillars of the enriching diversity. Many efforts have been done for enhancing Indigenous based knowledge and research in the Linguistic, Literature and Culture in the development of ethnic/indigenous communities in Nepal.

 

The most marginalized indigenous people are adopting traditional farming/fishing occupation. The frontiers indigenous people are politician, Military, Police and civil servant. The highlander indigenous societies are famous for mountain expeditionary and tourism entrepreneurs. The indigenous of capital city are academician and tradesman. Presently, 37.2 percent of total national populations about 125 tribal casts are indigenous population living from eastern lowland to northern arctic of Nepal. The local wines, local chickens are the goods for precious souvenir in the indigenous communities. The ethnic/indigenous tribal casts have different culture on birth, marriage and death rites. The indigenous have innovative ideas for fishing, honey hunting, herb medicinal healing.  The Tungana, Damphu are the best musical instruments for dancing and singing. The valued sculpture and literacy of Indigenous are immortal. The contribution of Indigenous people national economic growth and their culture and technology should assess, identify and promote.

 

National Language Policy and Recommendation Commission have been formed in Nepal. The research has been conducted on Major Issues, Constraints and Opportunities of on Indigenous Nationalities. The Task Force for Primary Level Textbook Development for various languages of ethnic/indigenous people has been formed. Also the government of Finland has studied in the Folklore and Folk-life in efforts by a group of high-level researchers
